Private Park Rules and Regulations

Amended by RPOA Board Members July 18, 2011

Property owners will be responsible at all times for their personal conduct as well as the conduct of their family members & guests. Rivermont Property Owners Association (RPOA) will not be held liable for accidents or damages whether intentional or accidental. Only Rivermont Property Owners and their authorized family members, current in assessment fees will receive a key to the three private parks. This key is to be in the possession of the Rivermont property owner (or authorized family member) only, no exceptions.  The authorized key holder must be present at all times with their guests.

1. Property owners must make reservations in advance for groups larger 12 (inclusive of the owner). To reserve the park a deposit will be required. If the reserving parties do not clean up the reserved park areas the will not be refunded.

*Deposits for the parks are as follows:  13-25 people–$25    51-75 people–$75

26-50 people–$50        75+ people—-$100

2. There will be no reservations accepted for the following holiday weekends: Easter, Memorial day, Fourth of July, and Labor Day. On these holiday weekends no groups larger that eight(8) will be allowed within the parks areas, this is to ensure that all property owners are able to enjoy the parks during these peak weekends.

3. There are absolutely no firearms allowed within the park areas, this includes air rifles, bows and arrows, BB guns ect. There are also no fireworks allowed within the park areas, any violation of these rules will be immediately reported to the Comal County Sheriffs Department.

4. There will be no off road vehicles allowed within the park boundaries, licensed vehicles must be kept on the paved roads only and adjacent parking areas. Violaters of this rule will be subject to a fine in the amount up to but not to exceed $100.00 plus expenses incurred by RPOA to repair damages, if applicable. State Staute 90.002 states that the operation of a motor vehicle in or on a protected freshwater area (the bed, bottom and banks up to the gradient boundary) is prohibited.

5. Park gates must be kept closed and locked at all times; there will be no exceptions . The park key must be in possession of the registered property owner.

6. Animals are not allowed within the pool area. At all three parks, animals must be kept on a leash at all times. Animals that are allowed to run loose will be reported to the Comal County Animal Control Department. Please clean up after your pet. Violators of this rule will be subject to a fine in the amount up to but not to exceed $25.00.

7. Glass and Styrofoam containers are not permitted within the three park areas; there are no exceptions to this rule.Violators of this rule will be subject to a fine in the amount up to but not to exceed $25.00 plus expenses incurred by RPOA to repair damages, if applicable..  State Statute 324.001 allows a fine up to $500.00.

The park key must be in possession of the registered property owner or authorized family member.

The following rules apply to the pool area only:

8. No food or glass inside the pool area. Violators of this rule will be subject to a fine in the amount up to but not to exceed $25.00.

9. Swimming at the pool is at your own risk, there is no lifeguard on duty and RPOA will not assume responsibility for accidents, injury or theft. No children under the age of twelve(12) are allowed within the pool enclosure without direct adult supervision.The park key must be in possession of the registered property owner. Violators of this rule will be subject to a loss of park privileges for a period up to but not to exceed 30 days.

10.       Pool hours are 9:00am-10:00pm daily from year round except Monday for maintenance.  If a holiday falls on Monday, the pool area will be closed on Tuesday for maintenance.

11.       The life preserver is for emergency use only; it is not to be used as a toy! Violators of this rule will be subject to a fine in the amount up to but not to exceed $25.00 plus expenses incurred by RPOA to repair damages, if applicable. Absolutely no diving or running will be allowed, no exceptions.

12.       Proper swimwear will be required of all property owners and guests, no street clothes, cutoffs allowed. All babies and small children must be in proper swimming attire (swimmer diapers or babies swim wear), no disposable diapers or cloth diapers allowed. Bacteria from diapers may cause health risks and the dyes contained in non-swimwear interfere with the chemicals used to aid in the pool’s ability to keep the water clean and sanitary.Violators of this rule will be subject to a fine in the amount up to but not to exceed $50.00 plus expenses incurred by RPOA to drain, clean, sanitize and refill, if applicable.

13.       No oversized swim floats allowed in the pool.

14.       Smoking is not allowed in the pool enclosure.

QUIET HOURS AT ALL THREE PARKS WILL BE MAINTAINED FROM 10 PM TO 7 AM

To ensure the enjoyment and safety at the Rivermont Property Owners, these rules will be strictly enforced. The RPOA Board of Directors, Property Owners, the RPOA Maintence Department, shall at all times have the authority to ensure that these rules and regulations are being complied with, and enforce by suspension or cancellation of the property owners private park privileges or civil charges aforementioned. If any laws are broken, Comal County Sheriff’s Department and Precinct 2 Comal County JP Court have the authority to ensure all laws are properly being complied with and will enforce them to the fullest extent of the law.

A copy of these rules and regulations are provided to each Rivermont Owner upon receipt of their own park key. Please familiarize yourselves as well as your guests regarding these expected rules and regulations.

As always, property owners accused of violations of park rules have the right to, for a period not to exceed thirty (30) days after the notification of violation, request a hearing with the board to discuss the violation prior to the board making a decision.

The key is the property of Rivermont Property Owners Association, issued to you for your use only. You are responsible for holding and safeguarding the key. The key must be returned on demand.   Any attempt to duplicate the key is a violation of Federal Law.
